These Terms of Service (these “Terms”) govern your access to and use of the Casa Arteaga Insurance website and any related online services, forms, and appointment scheduling tools (collectively, the “Site”). The Site is operated by Casa Arteaga Insurance LLC (“Casa Arteaga,” “we,” “us,” or “our”). By using the Site, you agree to these Terms.

1. Important Disclosures

  1. No insurance coverage is provided through the Site itself. The Site provides general information and a way to request contact, quotes, comparisons, and consultations. Any insurance coverage is provided only under the terms of an issued policy from a carrier (if any), subject to eligibility, underwriting, carrier approval, and payment of premiums.

  2. No professional advice. Information on the Site is for general informational purposes and is not legal, tax, accounting, medical, or financial advice. You should consult appropriate professionals regarding your specific situation.

  3. Third-party products. We may assist with Medicare-related plans, life insurance, annuities, and related products. Availability varies by location and eligibility, and carriers may change offerings.

2. Eligibility and Your Responsibilities

By using the Site, you represent that:

  • You are at least 18 years old (or the age of majority in your jurisdiction).

  • The information you submit is accurate, current, and complete.

  • You will use the Site only for lawful purposes and in compliance with these Terms.

You are responsible for safeguarding any device, account credentials (if any), and personal information you use to access the Site.

3. Permitted Use and Prohibited Conduct

You may use the Site for personal, non-commercial purposes to learn about services and request consultation.

You may not:

  • Attempt to interfere with the Site’s operation or security.

  • Use the Site to transmit malicious code, spam, or unauthorized advertising.

  • Scrape, harvest, or collect data from the Site without our written consent.

  • Misrepresent your identity or submit information on behalf of someone else without authority.

4. Appointments, Consultations, and Requests for Contact

The Site may allow you to request a consultation or schedule a “no obligation” appointment.
Submitting a request does not guarantee appointment availability or any particular outcome. We may contact you to confirm details, request additional information, or reschedule.

5. Communications Consent (Phone, SMS, Email, Mail)

By submitting your information through the Site, you acknowledge and agree that a licensed insurance agent from Casa Arteaga Insurance may contact you by phone, SMS (text), email, or mail to discuss and quote Medicare Advantage Plans, Medicare Supplement Insurance, or Prescription Drug Plans.

  • You can opt out at any time by replying STOP.
    (If available, replying HELP may provide additional assistance.)

Consent to receive communications is not a condition of purchase. If you prefer not to receive certain communications, follow the opt-out instructions or contact us using the information above.

6. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information.
If these Terms conflict with the Privacy Policy regarding personal information, the Privacy Policy controls.

7. Intellectual Property

The Site and all content on it (text, graphics, logos, images, layout, and other materials) are owned by Casa Arteaga or its licensors and are protected by applicable intellectual property laws.

You may view and print pages for personal use. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without our prior written permission.

The Site may contain links to third-party websites or services (for example, maps, reviews, scheduling, or social media). We do not control those third parties and are not responsible for their content, privacy practices, or services. Your use of third-party services is at your own risk and subject to their terms.

9. Disclaimers

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASA ARTEAGA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, error-free, or secure.

  • Any information on the Site is complete, current, or free of errors (although we strive for accuracy).

  • Communications sent through the Site will be delivered or received without delay.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASA ARTEAGA AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, CASA ARTEAGA’S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US (IF ANY) TO USE THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Casa Arteaga and its owners, officers, employees, agents, and affiliates from any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site,

  • Your violation of these Terms,

  • Your violation of any law or third-party right, or

  • Any information you submit through the Site.

12. Changes to the Site or Terms

We may update the Site and these Terms at any time. If we make changes, we will revise the Effective Date above. Your continued use of the Site after changes become effective constitutes your acceptance of the updated Terms.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if necessary to protect the Site, users, or Casa Arteaga.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising under these Terms will be brought in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue in those courts.

15. Miscellaneous

  • Entire agreement: These Terms (and the Privacy Policy) are the entire agreement regarding your use of the Site.

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • No waiver: Our failure to enforce a provision is not a waiver.

  • Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
